New regulatory regime for clinics and SPCs now in effect

The DH is now accepting clinic licence and exemption applications.

The regulatory regime for clinics and small practice clinics (SPCs) under the Private Healthcare Facilities Ordinance has taken effect, with the Department of Health (DH) now overseeing the new licensing system.

Clinics are required to obtain a licence, whilst SPCs may apply for an exemption to continue operating without one.

Clinics already in operation on or before 30 November 2018, the gazettal date of the Ordinance, may apply for a clinic licence between 13 October and 13 April 2026. The DH may issue provisional licences allowing these clinics to operate while awaiting full approval.

Facilities that began operations after the gazettal date, including newly established or relocated clinics, are required to apply directly for a full licence.

Meanwhile, clinic operators of SPCs can request letters of exemption from the department.

All applications and exemption requests can be submitted through the DH’s ‘e-Licensing’ system.
